Disagreement on IEP

My son is 9 and has an IEP I recently received the new IEP that the IEP team decided on (I was unable to attend because I was in the hospital) which was sent home for me to sign but I disagree with the changes. They are trying to lower the amount of time he spends in the special education classroom by one hour a day, so he will lose 5 hours a week, at the same time they are also saying he no longer qualifies for summer school program and they are taking away 4 of the 5 speech services he receives all to be started upon returning from summer break. So basically after 3 months vacation take away a lot of his services when last month he had a failing grade in Science on his progress report....any advice?

What state are you in? Legally, I'm not sure they can hold the IEP without you or make those changes without your permission. Ask to reconvene the IEP with you. I would be most concerned about what that extra hours in the gen ed setting would look like as in what class will he be not getting as much help with. http://wrightslaw.com/ is a great resource.

Were you given notice of the IEP meeting? There are specific procedures the school must follow. If so, did you tell them you couldn't attend and request a postponement? State your disagreement and ask for another meeting IN WRITING. You can always file for a due process hearing or, in some states, a meeting with a mediator. Good luck.

You do have to sign it and agree to an iep but you also have the right to refuse to sign the iep until you agree with it. I suggest you get a advocate there are programs like the ark where you can get one at no cost to you. Don't go to iep or parent teacher conferences alone with out a advocate.

State is Virginia and I was informed of the meeting however I had to have surgery and when I let them know they said something about a deadline to have it in and I was very sick and not doing well so I could not argue the fact but I never said it was okay. When the IEP was sent home for me to sign I missed it because I forgot to check my sons book bag, again because I just had surgery and my mom helped him with his homework and did not know. When my son brought it back to school unsigned she went to my ex husband who I thankfully get along with most of the time and actually asked that he sign it, he had never been to an IEP meeting and had really no idea what is going on in that area in detail enough to sign this IEP! I pulled it out before my ex could get it (doubt he would have signed it unless he just did it not knowing and trying to be helpful) and wrote all over it how I didnt agree and finally signed it because she kept bugging me but again wrote all over it now she wants me to

she wants me to sign another one so the one that goes into his file does not have these disagreements all over it however when I talked to her on the phone she told me that was fine...something does not seem right and I dont like it! I will be down there fighting as soon as I recover!

We just had an iep meeting. My 9 yr old autistic daughter had her iep yanked last year. I had to start over again! Well last. week they say she doesn't qualify for an iep! Of course we will move onto the next step too get a 2nd opinion. It's just awful she suffers in school while they play the game

My son has Autism and we live in Delawere so theres an advocacy group called Autism Delaware and they will assist you in obtaining the services your child needs. Also, again depending on what your childs disability is theres always their doctors. My son had a phenominal pediatric neurologist and he really went to bat for my son. Made the school listen to his recommendations and follow them.
