It’s one thing to complain about your job or your boss to your friends in the privacy of your home, but when you take it to a social networking site like Facebook you are making your opinions public for all to see.  One Connecticut woman found this out the hard way when she was fired from her job after making disparaging remarks about her boss on her personal Facebook page.  Her boss may have been offended, but was this grounds to have her terminated from her job?

The National Labor Relations Board doesn’t think so.  A recent report from CNN discusses the complaint they filed against the Connecticut ambulance service where the woman worked in what could be a precedent-setting case.  The labor board claims that the company illegally fired her and refused to allow her representation through her union after she made several critical remarks about her supervisor on Facebook.  One of the remarks the employee made was comparing her boss to a psychiatric patient. It is also being reported that she used vulgarities regarding her boss in some of the other comments she made.

According to the labor board’s Joanthan Kreisberg the employee was not breaking any rules and should not have been fired.  Kreisberg says, “You are permitted to talk about terms and conditions with employees or anyone else, it’s public because you are protected under the National Labor Act.”  The ambulance service, American Medical Response, being accused of firing the employee denies the reason for firing her was due to her Facebook comments.  Instead, they insist they fired her because of complaints that she was rude to patients.

I think it was dumb to post such things on a public website. Even if you have you page set to private, if you have others on there that work with you, it was a dumb move.

Honestly, I think it's a violation of her freedom of speech. When you are not working and are on your own page, you should have the right to say whatever you want. She may have chosen a poor forum for her complaints but if she's not on the clock then it is NONE of that company's business.

My company has strict social network rules about what you can say and not say if you want to complain. If you mention my company, you have to say "These are not words of the company and reflect my personal opinion". There are things you need to keep private. Saying you had a rough day at work is ok as long as you don't name names or the company's name. I also feel you shouldn't post pictures of comments of you on a ski trip if you are out sick or on any kind of medical leave. I have heard of that happening too and the employee is fired.

Best not bite the hand that feeds you. I would have fired her. She showed a great lack of respect. She has freedom of sppeech. Freedom is not free. It comes with consequences.

Its her facebook page . She can say what she wants. It looks to me like her boss didn't like her and was looking for a reason to fire her. If she wasn't on her friends list how did she know about it?

One of the reasons why I do not have a Facebook page. Those things always seem to cause trouble! If I want to share a picture with, or send a message to a friend or family member, I do it via e-mail.

She deserved to be fired! She talked crap and got caught and now she's paid the price. Freedom of speech does not mean freedom to be an @**hole! Had she acted like an adult, she could have gone to HR or someone higher up then her supervisor and dealt with things in a professional manner, but instead she chose the high school way and it cost her her job. Too bad so sad.

You can't regulate common sense. The employee, of course, should have used better judgment. In my opinion, this is a very poor reflection on the employee, and if the company rose above the employee's stupidity then the company would not have a lawsuit to deal with. It sounds like pride got in the way of both parties here.

For all of you yelling about FREE SPEECH!! Yes, we do have free speech in this country...we also have laws against defamation of character & slander, which according to this article, this woman was treading into (I cannot say exactly which one, if not both, she could be sued for, as we don't know *exactly* what she said.) She made specific remarks in print, for public view (as soon as she hit that post button!) about her boss, using vulgarities & comparing him to a psychiatric patient. If she simply wanted to vent, and just HAD to do it online, she could have done so without the nastiness (ie-"Man, I had a really crappy day at work. I'm having SERIOUS problems w/ 'certain people'...")

The internet is not a place to vent about your workplace, if one is unhappy with your employer, look elsewhere for employment, as someone posted earlier, a journal or close friends are perfect choices, not the internet, now the whole wide world knows.

Just to play devils advocate, why shouldn't she be allowed to vent her frustration with someone that made her workday miserable on her personal Facebook page. If the posts are made on personal time and do not contain lies, why shouldn't she be allowed to voice her opinion. If we are not allowed to post our personal opinions then wouldn't it play out that posting negative product reviews on a public site such as this would also render you as fair game for retribution from the products manufacturer? Is it OK if Bayer comes after me because I panned their product? I'm now dealing with a local company that I do work for that has decided not to pay me, answer phones or email. Would I be wrong to express my frustration and disgust with this "employer" on my Facebook page or in my blog? Where does the right to freely speak your mind end?
